These terms govern the quittum Connect service. They supplement the Licence Terms for quittum. Your licence and the use of quittum on your computer remain governed solely by the Licence Terms; Connect does not change them.

1. Provider and scope

quittum Connect is provided by MBYT LTD, Floor 2, 16 Apostolou Pavlou, 8046 Paphos, Republic of Cyprus, email office@mbyt.eu. These terms apply to consumers and businesses who subscribe to quittum Connect. A business within the meaning of these terms is anyone who expressly states when ordering that they are ordering as a business; all other customers are consumers. Deviating terms of the customer do not apply.

2. What quittum Connect is

quittum Connect is a subscription that lets you access quittum running on your own computer while you are away, using the browser of your phone or another device. To do so you open the web application at connect.quittum.de.

The connection between your device and your computer is first established through our brokering service (WebSocket). In the background both sides try a direct connection (WebRTC); if it succeeds, the connection continues directly. If it does not, for example on some mobile networks or behind company firewalls, the connection stays on the path through our brokering service. On both paths the connection is end-to-end encrypted; we cannot read the transmitted content.

Connect does not unlock any features that your quittum licence does not include. Through Connect you see and use what your computer can do with your licence, to the extent the web application offers it for use on the go. Connect does not issue another licence and does not synchronise data between computers.

3. No storage of your documents

Your receipts, documents and bookkeeping data stay on your computer. quittum Connect does not store them on our servers, not even temporarily as a file. Even via the brokering service they only pass through in encrypted form.

What we process to operate Connect (for example your account, identifiers of your devices and connection data) is described in the Privacy Policy.

4. Requirements and availability

Connect requires a quittum licence; the subscription belongs to that licence. Connect only works if

  • your computer is switched on, not asleep and connected to the internet,
  • quittum is running on that computer and Connect is switched on there,
  • your device is paired with the computer and has an internet connection, and
  • your subscription is active.

quittum can keep the computer awake while Connect is switched on (setting „Rechner wach halten“, “Keep computer awake”); you make sure the computer has power and an internet connection.

Connect is a connection to your own computer. You can reach what the switched-on computer provides. If the computer is off, asleep or offline, you cannot reach quittum through Connect. That is not an outage of the service but a requirement on your side. Uninterrupted operation of our brokering service is not part of the service. We announce planned maintenance in advance and fix disruptions promptly. The web application connect.quittum.de updates itself; you receive security updates without having to do anything.

If our service is disrupted although your computer and your device meet the requirements above, that is a defect. Your statutory rights for defects of digital services (sections 327i et seq. German Civil Code) remain unaffected.

Speed depends on the networks on both sides. Via the brokering service the connection may be slower.

5. Devices

Each subscription lets you pair up to five devices for access through Connect (remote devices). You pair a device by creating an invitation on the computer and giving it a name, opening it on the device as a QR code or link and confirming the request on the computer. An invitation can be used once, is valid for fifteen minutes and can be withdrawn on the computer before then. Knowing the link alone gives no access without your confirmation on the computer. You can remove a device on the computer at any time; it then loses access and frees its place.

Devices that open quittum in the browser within your own network (home network) do not count towards these five devices and do not need a Connect subscription.

You are responsible for who uses your paired devices. Only pass invitations to people who are allowed to access your data, and remove a lost device on the computer without delay.

6. Subscription, price and payment

Connect starts with a trial period of fourteen days, free of charge. We remind you by email three days before it ends. If you cancel during the trial, you pay nothing for Connect. If you do not cancel, Connect turns into the paid subscription when the trial ends; the first amount is due the day after.

Connect is billed monthly or annually. The price shown when ordering applies. Payment is processed by Stripe; the amount is due in advance at the start of each billing period. The monthly subscription renews for one month at a time unless you cancel it.

The annual subscription initially runs for one year. If you do not cancel it for the end of that year, it then continues for an indefinite period and can be cancelled at any time with one month’s notice. We refund the annual amount for the time after the end pro rata for each full month. For businesses the annual subscription renews for one year at a time.

If a payment fails, Connect remains usable for three more days so that a retry of the payment can go through. If it does not succeed, access through Connect ends.

7. Cancellation and end

You can cancel the subscription at any time with effect from the end of the trial or of the current billing period. The easiest way is „Connect kündigen“ (“Cancel Connect”) at the bottom of every page of quittum.de (quittum.de/connect/kuendigen), without signing in, either ordinarily or for good cause. You can also cancel by email to office@mbyt.eu. The email address you ordered Connect with is enough to cancel; the Connect identifier helps us find your subscription but is not required.

An online cancellation, ordinary or for good cause, takes effect when you send it on the cancellation page; you do not need to sign in or confirm anything else. We confirm it immediately by email to the address given, stating its content and the date and time.

So that nobody ends your subscription without your knowledge, this email contains the way back „Das war ich nicht“ (“This was not me”). If you did not cancel, one click within fourteen days restores the subscription at no cost to you. If the subscription was ended immediately by someone else’s cancellation, you keep using Connect without a new payment at least until the end of the period already paid, and we offer to continue the subscription at no extra cost.

A cancellation for good cause takes effect immediately; we review the reason afterwards. After an ordinary cancellation Connect remains usable until the end of the paid period. We do not refund paid periods pro rata unless these terms (section 6) or the law provide otherwise.

We may cancel the subscription ordinarily only to the end of the paid or promised term, for a yearly subscription therefore at the earliest to the end of the current year, and we inform you by email at least one month in advance.

The right of both parties to terminate for good cause remains unaffected. If we terminate for good cause, for example for misuse of the service, we refund what you have already paid for the time after the end, pro rata for each day started; we reserve the right to claim damages.

If you withdraw from the purchase of your quittum licence, Connect ends at the same time, because it cannot be used without the licence. We then refund what you have already paid for Connect in accordance with the statutory rules on withdrawal.

When the subscription ends, only Connect ends. New connections are then no longer possible, and we disconnect existing connections within a few minutes. Your licence, quittum on your computer and your data there remain unchanged. We delete your Connect account thirty days after the end.

8. Rules of use

You use Connect only to access your own quittum computers or those of your business. You may not resell the service, use it for purposes other than accessing quittum, in particular not use the brokering service as a general forwarding service, or circumvent measures that limit or secure access.

9. Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal information.

10. Liability, law and jurisdiction

Sections 10 and 14 of the Licence Terms apply accordingly to liability and dispute resolution.

The law of the Republic of Cyprus applies. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer protection rules of the state in which you have your habitual residence (Art. 6(2) Rome I Regulation).

Jurisdiction: consumers may sue us before the courts of their state of residence or in Cyprus and may be sued only in their state of residence. For contracts with businesses the exclusive place of jurisdiction is Paphos, Republic of Cyprus.

11. Changes

We change the price and content of your subscription only with your consent. We inform you of a change to these terms by email at least six weeks in advance; it only applies if you agree. If you do not agree, the subscription continues on the previous terms until one party cancels it ordinarily under section 7.

Separately, we may change the service technically where this is necessary for a valid reason, for example for security, for new browsers and operating systems or because of legal requirements, and it costs you nothing (section 327r German Civil Code). If such a change impairs your access or the usability more than insignificantly, we inform you clearly in advance by email, and you may end the subscription free of charge within thirty days of the information or the change, whichever is later.
